Welcome to Spawnd (operated by CospudProduction GmbH, Merseburgerstraße 200, 04178 Leipzig, Germany). These Terms of Service (“Terms”) govern your access to and use of our U.S.-facing online store at spawnd.eu (the “Store”), where physical products are printed and fulfilled via our production partner Gelato’s U.S. network. By placing an order, you agree to these Terms. If you do not agree, please do not use or order from our Store.

1. Definitions & Scope

• “We,” “us,” “our” refers to Spawnd.

• “You,” “your,” “Customer” refers to the purchaser of goods from our Store.

• These Terms apply exclusively to purchases of physical goods printed and shipped by Gelato’s U.S. print‐on‐demand network.

2. Your Account & Eligibility

• You must be at least 18 years old or have the consent of a parent or guardian to place an order.

• You agree to provide accurate, current, and complete information when creating your account or placing an order, and to keep it updated.

• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3. Product Descriptions & Availability

• We strive for accuracy in product images and descriptions, but actual colors or details may vary slightly due to device settings or print‐on‐demand processes.

• All products are produced and shipped by Gelato’s U.S. network. Estimated fulfillment and shipping times are provided at checkout but are not guaranteed.

4. Orders & Contract Formation

• When you place an order, you make an offer to buy the items in your cart. We accept your offer upon sending a Shipping Confirmation by email.

• We reserve the right to refuse or cancel any order for any reason (e.g., out of stock, pricing error, fraud). If we cancel, we will notify you and refund any payment received.

5. Pricing & Payment

• All prices are shown in EUR and include German VAT (19%). U.S. customers are responsible for any applicable local sales tax, import duties or customs fees.

• We accept credit/debit cards (Visa, MasterCard, American Express), PayPal, Apple Pay and Amazon Pay.

• Payment is processed at the time you place your order. If payment authorization fails, we may cancel your order.

6. Shipping & Delivery

• Delivery area: Continental United States only.

• Shipping costs: Free of charge.

• Fulfillment time: 2–5 business days for production, plus 3–5 business days for transit.

• No deliveries on weekends or U.S. federal holidays.

• If you order items with differing production times, we will ship them together once all are ready—delivery time is determined by the item with the longest production time.

• Title and risk of loss pass to you upon delivery by Gelato’s carrier.

7. Returns & Replacements (Voluntary Policy)

Note: This is a voluntary policy and not a statutory “cooling‐off” right.

1. Return Window: You may request a return or replacement within 14 days of delivery.

2. Non‐Defective Returns:

   • Returns of non‐defective items are accepted only within 14 days.

   • You bear all return‐shipping costs for non‐defective items.

3. Defective or Damaged Goods:

   • Notify us within 14 days of delivery if items arrive damaged or defective.

   • We will provide a free replacement and cover all shipping costs for defective items.

4. How to Return:

   • Contact us first via our Contact Form or at support@spawnd.eu to receive your personalized return instructions.

   • Do not ship items before receiving these instructions.

5. Condition of Returned Items:

   • Items must be returned in original packaging and resaleable condition, except for the defect.

   • You are liable for any diminished value resulting from handling beyond inspection.

8. Cancellation & Order Changes

• You may request order modifications or cancellations before production begins by contacting us immediately. We will attempt to accommodate but cannot guarantee changes once Gelato has started production.

9. Intellectual Property

• All content on our Store (designs, text, images, logos, trademarks) is owned or licensed by Spawnd or Gelato. No rights are granted to copy, distribute, or create derivative works without our express written permission.

10. Third-Party Services & Links

• Our Store is hosted on Shopify and powered by Gelato for printing/shipping. We do not control these platforms and disclaim liability for their performance.

• We may provide links to third-party sites; such links do not imply endorsement. Access third-party content at your own risk.

11. Disclaimer of Warranties

• “AS IS” & “AS AVAILABLE”: We make no express or implied warranties regarding the Store or the products, including merchantability or fitness for a particular purpose.

• Production and shipping times are estimates only.

12. Limitation of Liability

To the fullest extent permitted by law, Spawnd’s total liability for any claim arising from your use of the Store or products is limited to the purchase price paid. We are not liable for any indirect, incidental, consequential, or punitive damages.

13. Indemnification

You agree to indemnify and hold harmless Spawnd, Gelato, Shopify, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising out of your breach of these Terms or your use of the Store or products.

14. Governing Law & Venue

These Terms are governed by the laws of the State of New York, U.S.A. Any dispute must be brought exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction there.

15. Changes to These Terms

We may modify these Terms at any time by posting updated versions on this page. Your continued use of the Store after changes constitutes your acceptance of the new Terms.
